Terms of business
The practical terms
These terms apply when you book or buy coaching from me. They cover the practical side: prices, paying, rescheduling, refunds and what happens if plans change. I've written them to be read, so if anything is unclear, email me at matt@mattrutherfordcoaching.com before you book.
Who I am
Matt Rutherford, trading as Matt Rutherford Coaching, a business name registered in Ireland (registration number 795830). I'm based in Dublin and coach online. You can reach me at matt@mattrutherfordcoaching.com.
What these terms cover
Everything I sell: Coaching Sessions (single sessions and blocks), The Sounding Board, The Next Move and The Leadership Engagement. The Discovery Session is free, and nothing in it commits you to buying anything.
Blocks of sessions and the two programmes also come with a coaching agreement, which describes how we'll work together. Where the coaching agreement and these terms both mention fees or bookings, these terms apply.
Prices
Prices are in euro and shown on my coaching page. I'm not registered for VAT, so no VAT is added. The price you pay is fixed for that engagement. If my prices change, the change applies to new bookings only.
Paying
- Coaching Sessions and The Sounding Board are paid by card when you book.
- Blocks of sessions are paid by card, in advance, as a package.
- The Next Move and The Leadership Engagement are invoiced after our Discovery Session and paid by bank transfer or card. You can pay in full, or in instalments: two of €600 for The Next Move, three of €1,000 for The Leadership Engagement. The first payment is due before your first session; later instalments are due on the dates shown on your invoice.
- The Sounding Board fee is credited against The Next Move or The Leadership Engagement if you book either within 30 days of your Sounding Board session.
- If an organisation is paying, I invoice the organisation, and payment is due within 30 days.
How long sessions stay valid
- A block of four sessions is valid for six months from purchase, and a block of eight for twelve months.
- The Next Move runs over about twelve weeks. Its sessions need to be used within six months of your first session.
- The Leadership Engagement runs over about six months. Its sessions need to be used within nine months of your first session.
Sessions not used in time expire and aren't refunded. If life gets in the way, talk to me before they expire and we'll find a sensible answer.
Rescheduling and missed sessions
- You can move a session free of charge with at least 48 hours' notice, using the link in your booking confirmation or by emailing me.
- A change with less than 48 hours' notice, or a session missed without notice, counts as a session used. Genuine emergencies are at my discretion.
- If you're running late, the session still ends at the planned time. If you haven't joined after 15 minutes and haven't let me know you're on your way, I'll treat the session as missed.
- If a session is cut short by a technical problem, we'll make up the lost time at no cost.
- If I need to move or cancel a session, it never counts against you. We'll find a new time that suits you, and if we can't, I'll refund that session.
Your right to cancel within 14 days
If you're buying for yourself (not through an employer), you can cancel within 14 days of buying, for any reason, and get a full refund.
If you'd like a session to take place within those 14 days, I'll ask you to confirm that when you book. If you then cancel within the 14 days, you pay only for the coaching already delivered, and I refund the rest. If everything you bought has been fully delivered within the 14 days, the right to cancel no longer applies.
To cancel, email me. I'll refund you within 14 days, using the method you paid with.
Ending a programme or block early
Either of us can end the coaching at any time. I'd ask for a short closing conversation first.
- If we agree together that it isn't working, or I end the coaching, I refund any sessions paid for and not used, and cancel any instalments not yet due.
- If you decide to stop for your own reasons, sessions already paid for aren't refunded. They stay valid for six months from the date you stop, and any future instalments are cancelled.
This doesn't affect your right to cancel within 14 days.
Results and responsibility
Coaching supports your thinking and your decisions. I can't guarantee a particular outcome, such as a new job, a promotion or a pay rise. You remain responsible for your decisions and actions. Coaching isn't therapy, and it isn't medical, legal or financial advice.
Liability
If I'm responsible for a loss you suffer, my liability is limited to the fees you paid for the engagement concerned. Nothing in these terms limits any liability that the law doesn't allow me to limit, or takes away your statutory rights as a consumer. I hold professional indemnity and public liability insurance.
Privacy
How I handle your information is set out in my privacy statement. In short: I keep only what I need to run the business, and I don't share it.
Complaints
If you're unhappy with anything, please tell me first. I'll reply within five working days and do my best to put it right. If we can't resolve it between us, you can raise it with the Association for Coaching, whose Global Code of Ethics I work within.
Changes to these terms
I may update these terms from time to time, and each version is dated. The version in place when you book applies to that booking.
The law
These terms are governed by Irish law, and the courts of Ireland have exclusive jurisdiction over any dispute. If you're buying as a consumer, you keep all the protections the law gives you.
